Terms & Conditions (Local Prepaid Card - Business)
This Annex includes the terms and conditions governing your relationship with Garpa in connection with the use of the prepaid cards offered by Garpa (hereinafter, the "Prepaid Card"). Except where expressly provided otherwise, these terms and conditions form an integral part of the Terms and Conditions of the Virtual Account for Legal Entities, which shall be fully applicable. The Prepaid Card is issued in the name of the User (a legal entity) and assigned to the cardholders designated by the User from among its Authorized Users (each, a "Cardholder"). Capitalized terms not defined in these terms and conditions shall have the meanings given to them in the Terms and Conditions of the Virtual Account.
1. PREPAID CARD
1.1. The Prepaid Card is personalized and reloadable and may be used to purchase goods and services and/or withdraw funds in the Argentine Republic at establishments that accept MasterCard. It may also be used to purchase goods and/or services abroad at establishments that accept MasterCard. Under no circumstances may withdrawals be made outside the Argentine Republic. The Prepaid Card may be used to make payments in person, online, by telephone, or through any other enabled channel.
1.2. The Prepaid Card is not a credit, debit, or charge card and does not allow installment purchases. Payments or withdrawals made using the Prepaid Card shall be debited from the balance of available funds in the User’s Virtual Account. Furthermore, the Prepaid Card is not governed by the provisions of Credit Card Law No. 25,065.
1.3. The Prepaid Card is issued in the name of the User. The User may request one or more physical and/or virtual Prepaid Cards, each assigned to a designated Cardholder. The User is responsible for all Cards issued in its name and for all transactions made with them, regardless of the Cardholder.
2. FEES
2.1. The fees applicable to obtaining and using the Prepaid Card are available for consultation at all times in the Application (hereinafter, the "Fees"). Withdrawals from ATMs may be subject to additional fees charged directly by the companies responsible for the ATMs, without Garpa’s involvement.
3. APPLICATION FOR THE PREPAID CARD
3.1. When applying for the Prepaid Card, you must accurately, truthfully, and completely provide the information and documents requested from you in relation to the User and each designated Cardholder (legal name, Tax ID (CUIT), Cardholder information, etc.). You must also keep such information and documentation up to date.
3.2. All information or documentation provided to Garpa shall have the status of a sworn statement. Nevertheless, Garpa may request supporting documents or additional information to complete or verify the information you have provided, including when certain monthly transaction thresholds are exceeded.
3.3. The application for the Prepaid Card shall be deemed completed upon receipt of the Prepaid Card. Garpa may reject, suspend, or cancel your application if it detects inconsistencies in the information or documentation provided, or if you fail to provide any additional information or documentation requested. Garpa may also reject an application at its sole discretion in any case, without being required to provide you with a justification.
4. ACTIVATION AND USE OF THE PREPAID CARD
4.1. Once the Prepaid Card has been received, it may be activated through the Application and/or any other means made available by Garpa. If the envelope containing the Prepaid Card is damaged or has been tampered with, delivery must be refused and Garpa must be notified immediately.
4.2. Once activated, the Prepaid Card may be used during the validity period printed on its front and/or communicated through the Application, subject to the available balance in the Virtual Account and within the usage limits established by Garpa and/or the associated service networks.
4.3. The Prepaid Card is personal to and non-transferable by its designated Cardholder. The User is solely responsible for safeguarding and maintaining the confidentiality of each Card and its PIN and is liable for all transactions made with all Cards issued in its name. The User agrees to instruct its Cardholders regarding the use and confidentiality of credentials and to request the immediate cancellation of the Card when a Cardholder’s relationship with the User ends.
4.4. For security reasons, entering the Prepaid Card PIN incorrectly at an ATM may result in the Prepaid Card being retained by the ATM network.
4.5. Use of the Prepaid Card shall be subject to the availability of the MasterCard network, which is beyond Garpa’s control. Compliance with the requirements necessary to complete a transaction constitutes acceptance of the transaction and the resulting responsibility.
4.6. Use of the Prepaid Card is subject to the balance of available funds in the Virtual Account. Transactions made using the Card shall reduce the available balance in full and through a single debit. Under no circumstances may transactions be made for an amount exceeding the available balance.
4.7. Any cancellation of a purchase transaction must be requested from the merchant. The funds shall be refunded once MasterCard approves the cancellation.
4.8. If a chargeback is requested in connection with card payments, the review and resolution of the claim may take up to 120 (one hundred and twenty) calendar days from the commencement of the chargeback process.
4.9. The User may add and remove Cards and Cardholders through the channels made available by Garpa. The cancellation of a Card or removal of a Cardholder shall not affect the validity of the remaining Cards issued in the User’s name. The User may set usage limits for each Card within the limits established by Garpa.
5. VALIDITY PERIOD OF THE PREPAID CARD
5.1. The Prepaid Card shall be valid from the date of its activation until the expiration date shown on its front and/or indicated in the Application. Upon expiration of the validity period, the Prepaid Card shall be canceled automatically. Nevertheless, Garpa may cancel the Prepaid Card if it is not used for a period of 6 (six) months or longer.
5.2. If the Prepaid Card expires and/or is canceled, a new Prepaid Card may be requested through the enabled channels, and its issuance shall be at Garpa’s sole discretion.
6. REPORTING LOSS, ROBBERY, THEFT OR MISUSE; CANCELLATION AND REISSUANCE
6.1. You must immediately notify Garpa of the loss, theft, robbery, or misuse of the Prepaid Card. A Prepaid Card reported as lost, stolen (whether through theft or robbery), or misused shall be canceled and may not be reactivated.
6.2. You shall be solely responsible for use of the Prepaid Card until you report the event and obtain confirmation of cancellation from Garpa. Garpa and MasterCard shall not be liable for use of the Prepaid Card before its cancellation becomes effective.
6.3. Once the Prepaid Card has been canceled, the issuance of a new Prepaid Card shall be subject to the applicable Fees.
7. CANCELLATION OR SUSPENSION OF THE PREPAID CARD
7.1. You may request the voluntary cancellation of the Prepaid Card at any time through the channels made available by Garpa.
7.2. In addition, the Prepaid Card shall be canceled or suspended, without limitation, in the following cases: (i) if damage to, loss, robbery, or theft of the Prepaid Card is reported; (ii) pursuant to an order from a court or competent authority; (iii) suspected fraud or illegal or prohibited use, at Garpa’s or MasterCard’s sole discretion; (iv) suspension or cancellation of the Virtual Account; (v) failure to provide Garpa with requested information or documentation; (vi) breach of these terms and conditions; and (vii) removal of the Cardholder to whom the Card was assigned.
8. SUPPORT CHANNELS
8.1. Garpa offers various support channels for inquiries related to the Prepaid Card. You may obtain assistance through the Application or by email at help.ar@garpa.money.
9. TRANSACTIONS ABROAD
9.1. Where applicable, the exchange rate used to convert foreign currency into pesos for transactions made abroad using the Prepaid Card shall be the retail selling exchange rate published by Banco de la Nación Argentina at the close of business on the day preceding the transaction date ("BNA Exchange Rate"), together with any applicable taxes.
10. LIMITATION OF LIABILITY
10.1. Garpa does not guarantee uninterrupted access to the channels through which the Prepaid Card may be used, which may be unavailable due to technical issues, internet failures, unavailability of the MasterCard network or ATMs, or any other reason, including reasons beyond Garpa’s control.
10.2. The User releases Garpa and its affiliates from all liability for any direct damages, lost profits, or any other loss or damage that the User may have suffered in connection with Prepaid Card transactions that were carried out, declined, or restricted.
